Account and subscription agreement

Terms of Use

These Terms govern your access to The Sparky Standard website, mobile web app, accounts, subscriptions, questions, games, simulations and other training material (the Service). By creating an account or using the Service, you agree to these Terms.

The short version
  • One individual membership is for one person only.
  • Do not copy, record, redistribute, resell or repurpose Service content.
  • Organisations may purchase named All Access seats for their candidates; separate trainer permissions still apply.
  • The Service supports learning; it does not replace current standards, supervision or professional judgement.
  • Your rights under the Australian Consumer Law continue to apply.

1. Who these Terms apply to

“The Sparky Standard”, “we”, “us” and “our” refer to the operator of The Sparky Standard Service. “You” means the person who creates or uses an account. If you use the Service for a business or organisation, you confirm that you are authorised to accept these Terms for that organisation.

2. Accounts

You must provide accurate account information and keep your sign-in credentials secure. Individual accounts are personal, non-transferable and limited to one named user. You must not share credentials, permit another person to use your account, sell or transfer access, or use one account simultaneously for a class, workplace or group.

You are responsible for activity carried out through your account unless it results from a security failure outside your reasonable control. Tell us promptly if you believe your account has been accessed without permission.

3. Memberships and permitted use

Subject to these Terms and payment of the applicable fee, we grant you a limited, revocable, non-exclusive and non-transferable right to use the Service for your own learning and assessment preparation during your active membership.

An Electrician membership provides access to the Electrician & Apprentice pathway. An Inspector membership provides access to the Inspector in Training pathway and any foundation material identified as included. All Access provides both pathways and the core modules identified on the pricing page. Features may develop over time, but we will not remove a material paid feature during a prepaid period without a reasonable substitute, remedy or refund where required by law.

Organisation subscriptions grant one named candidate access per paid seat while the organisation subscription is active. The organisation owner may assign or remove candidate emails up to the paid seat count. A seat is not a licence to reproduce questions or distribute papers. Candidate results are not shared with an organisation merely because it pays for a seat; joining a trainer class requires separate candidate consent.

4. Free trial

Eligible new users may receive one 30-minute All Access trial. The timer begins only when the user actively starts the trial, continues in real time and cannot be paused. The trial does not require payment details unless clearly stated before it starts. Attempts to obtain repeat trials by creating duplicate accounts or using false details are prohibited.

5. Pricing, renewal and cancellation

Prices are shown in Australian dollars and include GST where applicable. Monthly and yearly memberships renew automatically at the interval selected until cancelled. The price, billing interval and renewal arrangement will be displayed before purchase.

You may cancel future renewal through the account or payment-management area. Cancellation takes effect at the end of the current paid period, and access ordinarily continues until then. We will not impose a cancellation fee unless it was clearly disclosed and is lawful. Refunds and remedies are provided where required by the Australian Consumer Law. Nothing in these Terms excludes, restricts or modifies a consumer guarantee, right or remedy that cannot lawfully be excluded.

6. Intellectual property and copying restrictions

The Service and its original content—including its question banks, explanations, calculations, scenarios, game logic, testing simulations, artwork, characters, photographs, videos, audio, layout, code, databases and branding—are owned by or licensed to The Sparky Standard and are protected by intellectual-property laws.

Except where Australian law permits an act that cannot be restricted by contract, you must not:

  • copy, reproduce, photograph, screen-record, download, scrape or extract a substantial part of the Service;
  • share questions, answers, images, simulations, access links or account credentials with another person;
  • publish, upload, distribute, transmit, sell, license or commercially exploit Service content;
  • use Service content to teach, coach or assess students through another training provider, RTO, TAFE, school, business, social-media channel, course or competing service without our prior written permission;
  • remove copyright, ownership or attribution notices;
  • reverse engineer, bypass access controls, automate collection or interfere with the Service; or
  • use the Service or its content to build, train or improve a competing product, question bank, model or training system.

You may make reasonable personal study notes in your own words. This permission does not allow reproduction of the question bank, screenshots, answer keys or other substantial content.

7. Standards, regulators and third-party material

The Sparky Standard is an independent training service and is not endorsed by or affiliated with any assessment provider, standards publisher, licensing authority, regulator or training organisation. References to standards, regulations, assessment types and trade names are used only for identification and education.

The Service does not provide unauthorised copies of standards. You are responsible for obtaining lawful access to current standards, regulations, manufacturer instructions and workplace procedures. If Service content conflicts with a current authoritative source, the authoritative source applies.

8. Training and safety disclaimer

The Service is general educational material and assessment preparation. It is not legal advice, engineering advice, a statement of regulatory approval, a licence, a competency determination or a substitute for qualified supervision. It does not guarantee that you will pass an assessment or obtain a licence.

Electrical work must only be performed by appropriately licensed, authorised or supervised persons using current requirements, safe-work procedures and site-specific risk controls. Do not rely on a game or simulation when deciding whether actual electrical equipment is safe or energised.

9. Acceptable use

You must not use the Service unlawfully, submit malicious code, interfere with another user, manipulate rankings or results, impersonate another person, probe security controls, or use automated tools to access the Service without written permission.

10. Suspension and termination

We may restrict or suspend access where we reasonably believe there has been account sharing, copying, fraud, a security risk or a serious breach of these Terms. Where practical, we will explain the issue and give you a reasonable opportunity to respond. Immediate action may be taken to protect users, intellectual property or system security. Termination does not remove accrued rights or obligations.

11. Availability and updates

We aim to keep the Service available and accurate but cannot promise uninterrupted or error-free operation. We may carry out maintenance, correct content and release new versions. We may update these Terms prospectively by giving reasonable notice of material changes. Changes will not remove rights already accrued and will not apply unfairly.

12. Liability

To the maximum extent permitted by law, we are not responsible for indirect or consequential loss arising from reliance on training content, assessment outcomes, lost progress, internet interruptions or use of the Service contrary to these Terms. Where liability cannot be excluded but can lawfully be limited, our liability is limited to the remedies permitted by law. This section is subject to your non-excludable rights under the Australian Consumer Law.

13. Privacy

Our Privacy Notice explains how account and usage information is handled. By using the Service, you acknowledge that notice.

14. Governing law

These Terms are governed by the laws of Victoria, Australia. Courts with jurisdiction in Victoria may hear disputes, subject to any rights you have to bring a claim elsewhere under applicable consumer law.
